Terms and Conditions
Please read this agreement carefully before accessing or using the information
and services available through the Australian Thoroughbred Racing Employment
Centre website (“ATREC”). By accessing or using ATREC, you agree
to be bound by the terms and conditions below.
The Australian Racing Board Limited (“the ARB”) may modify
this agreement at any time, and such modifications shall be effective immediately
upon posting the modified agreement on ATREC.
- All intellectual property on ATREC belongs to the ARB or its licensors,
and users obtain no interest in that property.
You agree that information
contained on ATREC is for personal use only and may not be sold, redistributed
or used for any commercial purpose (this includes, but is not limited to
the use of Advertiser contact details for unsolicited commercial correspondence).
You may download material from ATREC for your personal, non-commercial
use only, provided you keep intact all copyright and other proprietary
notices.
You may not modify, copy, reproduce, republish, upload, post, transmit
or distribute in any way any material from this Site including code and software.
You must not use ATREC for any purpose that is unlawful or prohibited by
these terms of use.
Users acknowledge that the ARB may use all intellectual property in
material provided by users throughout the world without restriction, free
of charge.
- The ARB does not endorse or recommend any of the jobs, business or self-employment
opportunities advertised on ATREC and the ARB strongly recommends that
prior to entering into any agreement with any of the Advertisers on ATREC,
that you obtain your own independent legal, accounting, financial or taxation
advice as appropriate.
It is solely your responsibility to evaluate the
accuracy, completeness and usefulness of all opinions, advice, services,
merchandise and other information provided through ATREC or on the Internet
generally.
In no event will the ARB be liable to you or anyone else for any decision
made or action taken by you or anyone else in reliance upon any information
contained on or omitted from ATREC.
- Users and employers warrant that they have not relied on any representation
made by the ARB which has not been expressly stated in these terms and
conditions, or upon any descriptions, illustrations or specifications contained
in any document including publicity material produced by the ARB.
- The ARB will not be liable for any loss caused by a failure to complete
an application.
- The ARB gives no guarantee to you of the continued availability of any
particular job advertised on ATREC and will not be liable to you should
an advertiser have filled the vacancy at any time prior to removal of the
advertisement from ATREC.
Whilst the ARB takes efforts to ensure that jobs advertised are for actual
job vacancies, it gives no guarantee to you that every job advertisement
represents an actual job vacancy.
- The ARB accepts no responsibility for the content of any job notices
as they appear on this site and candidates acknowledge that the ARB has
no control over the quality, safety or standard of positions advertised
on this site or the truth or accuracy of the information contained in the
job notices and that any illustrations or photographs displayed on this
site are solely for the guidance of prospective candidates and are not
to be relied upon.
- The ARB provides no warranty to you that the services generally available
through ATREC will be uninterrupted or error-free or that defects in the
service will be corrected. You also understand that the ARB cannot and
does not guarantee or warrant to you that files available for downloading
through ATREC or delivered via electronic mail through ATREC will be free
of infection or viruses, worms, Trojan horses or other code that manifest
contaminating or destructive properties. You are responsible for implementing
sufficient procedures and checkpoints to satisfy your particular requirements
for accuracy of data input and output, and for maintaining a means external
to ATREC for the reconstruction of any lost data.
- The users and employers acknowledge that all correspondence concluded
on ATREC and all activities of the ARB are made and concluded in New South
Wales .
- Candidates expressly acknowledge that any use of information employers
gain from job notices appearing on ATREC will be at the candidates’ own
risk as the ARB accepts no liability for the accuracy or reliability of
information contained within those notices.
- The ARB welcomes ideas and feedback from you about all aspects of ATREC.
You agree that the ARB may reproduce, distribute, transmit, create derivative
works of, and publicly display any materials and other information (including
ideas for new or improved products and services) that you submit to any
public areas of ATREC (such as bulletin boards, forums and newsgroups)
or by email to the ARB.
- While the ARB takes all due care in ensuring the privacy and integrity
of the information you provide, the possibility exists that this information
could be unlawfully observed by a third party while in transit over the
Internet or while stored on the ARB systems or on the ARB’s Site.
The ARB disclaims all liability to you to the greatest extent possible
pursuant to law should this occur.
- The users and employers agree to be bound by these terms and conditions.
- These terms and conditions shall be governed by the laws of the state
of New South Wales . The parties agree to submit to the exclusive jurisdiction
of the courts exercising jurisdiction there.
- You agree that it is a condition on your use of any services provided
by the ARB or through ATREC that you will not either through any act or
omission mislead or deceive others.
- Users warrant that all information they provide on the site is accurate,
does not breach any law or the rights of any person. Users must not impersonate
any person or entity or falsely state or otherwise misrepresent their affiliation
with a person or entity or forge any TCP/IP packet header or any part of
the header information in any email or newsgroup posting.
- The ARB will not be liable for any damages (including direct, indirect,
consequential, incidental and exemplary):
- if a candidate is not given, or does not obtain a job for any reason;
- if there is any deficiency or inaccuracy in the site attributable
to a lack of maintenance of the site;
- in relation to a notice or resume not appearing according to instructions;
or
- in respect to services supplied by the ARB under these terms and conditions.
- The ARB may, at its discretion, refuse to accept for publication (or
remove from ATREC) a notice or resume if it believes the notice or resume
may infringe the rights of any person or may not comply with all the laws
and regulations of the States and Territories.
- On lodging material with the ARB for publication on ATREC, users and
employers indemnify the ARB and its officers, employees and agents against
any claim, demand, injury, direct or indirect damage, loss or cost, liability,
right of action or claim for compensation in contract, under statute or
in tort (including negligence) made against or suffered by any of those
indemnified arising, in whole or in part, as a result of:
- the publication of the notice or resume; or
- any activity that is expressed in these terms and conditions to be
the responsibility of the user or recruiter; or
- a breach of these terms and conditions.
- Users and employers agree to fully indemnify the ARB, its officers,
employees and agents in relation to defamation, liable, slander of title,
infringement of copyright, infringement of trademarks or names of publication
titles, unfair competition, breach of Trade Practices or Fair Trading legislation,
violations of rights of privacy, confidential information, licences, loyalty
rights or other intellectual property rights.
